Terms of Service
1. What RootBasket is
RootBasket is a technology platform that lets restaurants receive and manage orders through their own WhatsApp Business number, and lets customers place and track those orders in a WhatsApp conversation.
2. Pilot status
The service is a closed pilot. It may be changed, interrupted or discontinued at any time, and availability is not guaranteed.
3. Using the service
- You need an active WhatsApp account and must comply with WhatsApp's own terms.
- You must be at least 16, or have a parent's or guardian's consent.
- You are responsible for the accuracy of what you send — items, quantities, address and any allergy notes.
- An order is binding once the restaurant confirms it; cancellation follows that restaurant's policy.
- Connected restaurants must keep menus, prices and allergen data accurate, comply with the WhatsApp Business Messaging and Commerce Policies, and only message customers who have consented.
You may not use the service to send spam, impersonate others, sell goods prohibited by the WhatsApp Commerce Policy, interfere with the service, or break the law.
4. Dependence on WhatsApp
The service runs on the WhatsApp Business Platform, operated by Meta, which we do not control. Outages, policy or pricing changes, delivery failures or suspension of a number by Meta may interrupt the service, and we are not liable for them.
5. Payments
Where online payment is offered it is handled by an external payment provider. We never receive or store card details. Refunds are a matter between the customer and the restaurant.
6. Liability
We are liable without limitation for damage caused by intent or gross negligence, for injury to life, body or health, and under the German Product Liability Act.
For slight negligence we are liable only where a material contractual obligation is breached, and then only for foreseeable damage typical of this kind of contract. Further liability is excluded. During the pilot the service is provided free of charge, and in accordance with § 599 BGB we are liable only for intent and gross negligence in respect of that provision.
7. Termination
Restaurants may stop using the service at any time by disconnecting their WhatsApp Business Account. We may terminate access with reasonable notice, or immediately for a serious breach of these terms.
8. Governing law
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Where you are a consumer, this does not deprive you of the protection of mandatory provisions of the law of your country of residence.
